Terms of sale

These terms of sale govern every order placed on grainesdepelerins.com. We have written them to be clear: who we are, how an order works, delivery, your rights and how to reach us.

Who we are

The products are sold by MACTJ, a French simplified joint-stock company (SAS) with a share capital of €2,000, which operates the Graines de Pèlerins brand. It is represented by its President, Tomi Jerjir.

Registered office: 8 bis rue Abel, 75012 Paris, France
Paris RCS 931 065 163 · EU VAT number FR88931065163
Email: contact@grainesdepelerins.com
Customer service by email: Monday to Friday, 9 am to 6 pm, and Saturday, 10 am to 4 pm (Paris time). We reply within 24 working hours.

Who these terms apply to

They apply to purchases made on the website by consumers, for delivery to one of the countries listed under Delivery. By confirming your order, you declare that you have read and accepted them. The terms in force on the day of your order apply. Corporate gift orders may be subject to specific terms agreed with you.

Our products

We sell honeys, honey gift boxes and coated almonds. Each product page sets out its main characteristics: origin, weight, ingredients, allergens and storage advice. This information also appears on the label, which is the reference.

Every honey is delivered in its presentation box with its spoon, every gift box with one spoon per jar. Almonds are delivered in their pouches.

Our photographs are as faithful as possible. Honey is a natural product: its colour and texture may vary slightly from one jar to another, and it may crystallise naturally over time. Honey is not recommended for children under 12 months.

Our products are made in small batches, while stocks last. Should a product become unavailable after your order, we will let you know straight away and refund the amount paid for that product within 14 days at the latest.

Prices

Our prices are shown in euros, all taxes included (VAT included). Any delivery costs are shown before you confirm your order and appear in the order summary. The price due is the one displayed when you confirm your order.

Your order

You choose your products, check your basket, enter your address and delivery method, then proceed to payment. Before paying, you see the full summary (products, quantities, prices, delivery costs and total) and can correct any item. Clicking the final payment button places the order with an obligation to pay.

We then send you a confirmation email summarising your order. For any order of €120 or more, we keep the written record of the contract for ten years and give you access to it on request.

We may cancel an order if payment authorisation is refused or if an earlier payment dispute remains unresolved. You will be informed and no amount will be retained.

Payment

Payment is due when you order and is made on a secure payment page. The accepted payment methods are shown at checkout. Your card details are encrypted and processed by our payment providers: we never have access to them in full. Where payment in instalments is offered by a provider (for example Klarna), it is subject to that provider’s terms.

Subscriptions

Some products can be bought as a subscription: the 3-month honey ritual and our gift boxes, both delivered every 3 months. A subscription involves no commitment: it renews automatically at each due date, and each shipment is charged to the payment method used when you ordered, until you cancel it. You can cancel it at any time, at no cost, from your subscription portal or by email: the cancellation applies to shipments that have not yet been charged.

The frequency and price of each shipment are shown on the product page and in the payment summary, before you confirm your order. The rules specific to subscriptions are set out in our subscription terms, which form part of these terms of sale.

Delivery

Free Mondial Relay delivery · France, Belgium and Luxembourg

We deliver to mainland France, Belgium, Luxembourg, Germany, Austria, Spain, Italy, the Netherlands and Portugal.

To a Mondial Relay pickup point (France, Belgium, Luxembourg): free. To your door with Colissimo (France, Belgium): €7.90 for orders under €79, €4.90 from €79 to €89.99, free from €90, based on the product amount after discounts. To your door in the other countries we serve: €9.90. The exact delivery cost of your order is always shown before payment.

We usually prepare your order within 48 working hours. In France and Belgium, delivery then takes 3 to 5 working days. For other countries, the estimated date for your address is shown at checkout. These times may lengthen a little before the festive season. Unless a different date is given when you order, we deliver no later than 30 days after the order.

If delivery does not take place within the agreed time, you may ask us to deliver within a reasonable additional period and, failing that, terminate the contract in writing; we then refund you within 14 days at the latest (articles L216-1 et seq. of the French Consumer Code).

Your products travel under our responsibility until you, or the person you have designated, take possession of them. If a jar arrives cracked or damaged, send us a photo of the jar and the parcel: we will send you a new one, at our expense, without asking you to return anything. Details are in our shipping policy.

Your right of withdrawal

As long as your order has not been dispatched, you can cancel it at no cost by writing to contact@grainesdepelerins.com: we refund you in full.

Once your order has been dispatched, you have 14 days from receiving it to withdraw, without giving any reason and without bearing any costs other than those of the return. To do so, tell us of your decision before that period ends, by email, by post or using the form below, then send the products back within the following 14 days at the latest, to: Graines de Pèlerins · MACTJ, 8 bis rue Abel, 75012 Paris, France.

The cost and risk of the return are borne by you. Products must come back unopened, complete (closed jars, presentation box, spoon) and in perfect condition. You are liable for any loss in value resulting from handling beyond what is needed to establish their nature and characteristics: an incomplete, damaged or used product is refunded minus that loss in value. A parcel refused on delivery or not collected from the pick-up point comes back to us: the cost of that return is borne by you.

We refund you no later than 14 days after being informed of your decision, using the same payment method as for your order. The refund includes the original delivery costs up to the price of our cheapest standard delivery; any extra cost resulting from choosing a more expensive delivery method is not refunded. We may withhold the refund until we have received the products or until you have supplied proof of having sent them back.

Exception: under article L221-28, 5° of the French Consumer Code, the right of withdrawal does not apply to jars and pouches unsealed or opened after delivery, which cannot be returned for reasons of hygiene and health protection. An opened jar is neither taken back nor refunded.

For a subscription, the 14-day period runs from receipt of the first shipment, and withdrawal ends the subscription. Free cancellation before dispatch applies to the first order. Later shipments do not start a new withdrawal period: to avoid receiving them, cancel before their charge date, as explained in our subscription terms.

Legal guarantees

We are answerable for lack of conformity and hidden defects in our products, under the conditions laid down by law. To use these guarantees, write to us at contact@grainesdepelerins.com describing the problem, with a photo if possible. The following is a translation of the information required by French law.

The consumer has two years from delivery of the goods to obtain the application of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity, not the date on which it appeared.

Where the contract of sale provides for the continuous supply of digital content or a digital service for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer only has to establish the existence of the lack of conformity affecting the digital content or digital service, not the date on which it appeared.

The legal guarantee of conformity obliges the trader, where applicable, to provide all updates needed to keep the goods in conformity.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer asks for the goods to be repaired but the seller imposes a replacement, the legal guarantee of conformity is renewed for two years from the date of replacement.

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if:
1° The trader refuses to repair or replace the goods;
2° The repair or replacement takes place after thirty days;
3° The repair or replacement causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° The lack of conformity persists despite the seller’s unsuccessful attempt to bring the goods into conformity.

The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer does not then have to ask for repair or replacement first.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the goods are returned in working order.

The rights set out above result from articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who in bad faith obstructs the application of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.
